TERMS AND CONDITIONS OF SALE

- SCOPE AND CONTRACTING PARTY
1.1 These Terms apply to all orders placed through the online shop at (the "Shop").
1.2 Your contracting party is: Lumazen GmbH, Sankt Leonhard-Strasse 45, 9000 St. Gallen, Switzerland. Email: . Phone: +41 78 311 36 05. UID / VAT no.: CHE-284.855.497 MWST. Managing director: Veronica Sylvia Gašpar.
1.3 "We" and "us" refer to that company. "You" refers to the customer. A consumer is a natural person who orders for purposes outside their trade or profession. Some provisions apply to consumers only and say so.
1.4 We deliver to addresses in Switzerland and Liechtenstein only.
- PRODUCTS
2.1 Our products are cosmetics for external use. They are not medicinal products and are not intended to diagnose, treat, cure or prevent any disease.
2.2 Read the label and follow the directions for use. Perform a patch test before first use. Stop using a product if irritation occurs and consult a doctor if it persists.
2.3 Product images are for illustration. Packaging, colour and texture may differ slightly from the images.
- ORDERING AND CONCLUSION OF THE CONTRACT
3.1 The presentation of products in the Shop is an invitation to order, not a binding offer.
3.2 You order in these steps: (1) add products to the cart; (2) open the checkout and enter your contact, delivery and payment details; (3) check all entries on the review page, where you can go back and correct them or change the cart at any time; (4) click "Pay now" to place a binding order.
3.3 After you place an order, we send an email confirming that we received it. This email is a receipt, not yet an acceptance. The contract is concluded when we send you the shipping confirmation or deliver the goods, whichever comes first, and at the latest five working days after the order. If we cannot accept an order, we will tell you promptly and refund any payment already made.
3.4 The contract language is English. We store the text of the contract (your order details and these Terms) and send it to you with the order confirmation. You can also view past orders in your customer account.
3.5 Orders are accepted from persons aged 18 or over. We may limit quantities to normal household amounts.
- PRICES AND PAYMENT
4.1 All prices are shown in Swiss francs (CHF) and include the statutory value added tax. Shipping costs are shown separately in the Shipping policy and at checkout before you place the order.
4.2 Payment is due when you place the order. This also applies to pre-orders (clause 5.5). The payment methods available are shown at checkout. Payments are processed by our payment service providers.
4.3 If a price was displayed with an obvious error, we will contact you before shipping. You may then cancel the order free of charge.
- SHIPPING AND DELIVERY
5.1 Delivery countries: see clause 1.4. Delivery times are stated in the Shipping policy. They are estimates counted from dispatch, not guaranteed dates, unless we have agreed a fixed date in writing.
5.2 If a product is unavailable, we will inform you promptly and refund any payment made for it.
5.3 For consumers, the risk of accidental loss or damage passes to you when the goods are handed over to you or to a person you have named. For business customers, risk passes when the goods are handed to the carrier.
5.4 We may make partial deliveries at our own cost where this is reasonable for you.
5.5 Pre-orders. Products marked "Pre-order" are not yet in stock. The expected dispatch date is shown on the product page, in the cart and in your order confirmation. It is an estimate, not a guaranteed date. If an order contains a pre-order product together with other products, the whole order is dispatched together once the pre-order product is available, unless we choose to make a partial delivery under clause 5.4. If the expected dispatch date changes, we will inform you by email. You may cancel a pre-order at any time before dispatch by writing to team@lumazen.skin, and we will refund the full amount paid to your original payment method within 14 days.
- RETURNS AND RIGHT OF WITHDRAWAL
6.1 Swiss law does not provide a statutory right of withdrawal for purchases made online. We nevertheless grant you a voluntary right of return: you may return products within 30 days of receipt provided they are unused, in their original packaging and with the tamper seal intact. Contact with your order number before returning anything. Return shipping within Switzerland is free of charge. We refund the purchase price to the original payment method within 14 days of receiving the returned goods.
- WARRANTY
7.1 The statutory warranty for defects under the Swiss Code of Obligations applies. Claims for defects become time-barred two years after delivery. Please inspect the goods on receipt and report any defect to as soon as you discover it, stating your order number.
7.2 If a product is defective, we will at our choice replace it or refund the price, unless the law gives you a wider choice, in which case the law applies.
- LIABILITY
8.1 We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under mandatory product liability law.
8.2 In all other cases, we are liable only for the breach of obligations that are essential to the contract and only for the damage that is typical and foreseeable for this kind of contract. Any further liability for slight negligence is excluded. This limitation also applies to our employees, representatives and agents.
- RETENTION OF TITLE
The goods remain our property until the purchase price has been paid in full.
- INTELLECTUAL PROPERTY
All content of the Shop, including texts, images, videos, logos and the Lumazen brand, is protected by copyright and trademark law and belongs to us or our licensors. You may not reproduce or use it without our written consent, except for your own personal, non-commercial use of the Shop.
- DATA PROTECTION
We process your personal data in accordance with our Privacy policy, which you can find in the footer of the Shop.
- DISPUTE RESOLUTION AND CONSUMER INFORMATION
12.1 If you have a complaint, please contact us first at . We aim to reply within five working days.
- APPLICABLE LAW AND PLACE OF JURISDICTION
13.1 These Terms and all contracts concluded under them are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is St. Gallen, Switzerland. Mandatory places of jurisdiction for consumers under the Swiss Civil Procedure Code remain reserved.
- FINAL PROVISIONS
14.1 If any provision of these Terms is or becomes invalid, the remaining provisions remain in force.
14.2 We may amend these Terms for future orders. The version published in the Shop at the time of your order applies to that order.
